Septic System Maintenance Agreements in NSW: What to Look For

A maintenance agreement (also called a service contract or service plan) for your septic or AWTS system is the practical mechanism that ensures your system stays compliant, functional, and off Council’s radar. For AWTS owners in particular, a maintenance agreement is not optional, NSW regulations require quarterly servicing by an accredited service provider, and that relationship works best when it is formalised in a service agreement rather than booked ad hoc.

Why a Formal Agreement Makes Sense

Property owners who rely on ad hoc bookings for septic maintenance frequently experience problems:

  • Missed service cycles: Relying on memory to book the next quarterly service means the April service doesn’t get booked until June. Quarterly becomes semi-annual. Semi-annual becomes “whenever.”
  • Council compliance gaps: Each missed AWTS quarterly service is a gap in the service record lodged with Port Macquarie Hastings Council. A pattern of late or missed services triggers compliance audits and notices to improve.

For conventional septic tanks without AWTS, the agreement typically covers:

  • Annual inspection visits
  • Coordination of pump-outs when sludge levels reach the action threshold
  • Service record maintenance

Council Reporting

The agreement should specify that the service provider will lodge service reports with Port Macquarie Hastings Council on your behalf after each visit. Confirm:

  • What format the reports are lodged in (electronic submission preferred)
  • How quickly reports are lodged after the service (same week is reasonable; two months later is not)
  • Whether you receive a copy of each report for your own records

If your service provider is not lodging reports with Council, your compliance record is not being maintained, even if the services are being conducted.

Emergency Response

A service agreement is typically for servicing only, not for repair of failed components. The agreement should be clear:

  • Inspections will identify components needing replacement
  • Repairs (aerator replacement, pump replacement, UV lamp) are billed separately at agreed rates or market rates
  • The service provider will provide quotes for repairs before proceeding

Some providers offer bundled agreements that include minor component replacements (UV lamp, chlorine tablets, small parts). These can represent good value but read the detail on what is included vs excluded.

Agreement Term and Renewal

Standard maintenance agreements run for 12 months with annual renewal. Confirm:

  • Auto-renewal terms (you should have the right to terminate with reasonable notice, typically 30 days)

What Makes a Service Agreement Less Than Adequate

“Quarterly service” but no defined scope: If the agreement says “quarterly service” but doesn’t specify what is done at each visit, you have no basis for holding the provider accountable.

No Council reporting commitment: If the agreement doesn’t mention lodging reports with Council, you cannot assume they will do it.

Very low price that seems too good: Sub-$100 per visit quarterly services are unlikely to be conducted properly. The travel time alone, plus the service components and consumables, means below-market pricing often means below-standard service.

No emergency contact provision: An agreement with business-hours-only availability for a system that can fail at any time is inadequate.

Automatic annual price increases exceeding CPI: CPI-linked annual adjustments are reasonable. 20% per year “due to increased costs” without notice is not.
